Terms of Service

These Terms of Service (“Terms”) govern your access to and use of textmaddie.com (the “Site”) and the iMessage outreach services provided by RTF Labs (“Maddie,” “we,” “us,” or “our”), together the “Services.” By using the Services, you agree to these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the Services. You may not use the Services if you are prohibited from doing so under applicable law.

The Services

Maddie provides AI-assisted messaging, lead engagement, qualification, scheduling, customer support, and related tools. Service features may vary by customer and may change as we improve the Services. If you have a separate written agreement with us, that agreement controls to the extent it conflicts with these Terms.

Your Responsibilities

You are responsible for:

• Providing accurate information and keeping your account and contact details current;
• Maintaining the security of any credentials used to access the Services;
• Obtaining all permissions and consents required to provide contact information to us and to send messages through the Services;
• Following applicable communications, privacy, marketing, and consumer-protection laws; and
• Promptly honoring opt-out requests, including requests made by replying STOP.

Acceptable Use

You may not use the Services to:

• Send unlawful, deceptive, fraudulent, threatening, abusive, or unsolicited messages;
• Violate another person's privacy, publicity, intellectual property, or other rights;
• Distribute malware, interfere with the Services, or attempt to gain unauthorized access to any system or data;
• Reverse engineer, copy, resell, or exploit the Services except as permitted by law or a written agreement with us; or
• Misrepresent your identity or use the Services in a way that could harm Maddie, our customers, or message recipients.

We may suspend or terminate access to prevent harm, address a suspected violation, or comply with law.

AI-Generated Content

The Services use artificial intelligence and may produce content that is incomplete, inaccurate, or inappropriate. You are responsible for reviewing outputs as appropriate for your use case and for decisions made based on them. You should not rely on the Services for legal, medical, financial, or other professional advice.

Your Content and Data

You retain ownership of content and data you provide to the Services. You grant us a limited right to host, process, transmit, and otherwise use that content and data as needed to provide, secure, and improve the Services. Our collection and handling of personal information is described in our Privacy Policy.

Our Intellectual Property

The Services, including their software, designs, branding, and other content, are owned by RTF Labs or our licensors and are protected by intellectual property laws. These Terms give you a limited, non-exclusive, non-transferable, revocable right to use the Services in accordance with these Terms. No other rights are granted.

Third-Party Services

The Services may connect to third-party products such as Apple iMessage, scheduling platforms, and analytics providers. We do not control those products and are not responsible for their availability, content, or practices. Your use of them may be governed by separate terms.

Fees

Fees, payment terms, and subscription details, if applicable, are described in your order form or other written agreement with us. Unless that agreement states otherwise, fees are non-refundable except where required by law.

Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

Limitation of Liability

To the fullest extent permitted by law, RTF Labs and its affiliates, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from or related to the Services. Our total liability for all claims relating to the Services will not exceed the amount you paid us for the Services during the 12 months before the event giving rise to the claim, or $100 if you did not pay us.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless RTF Labs and its affiliates, officers, employees, and agents from claims, damages, losses, and expenses, including reasonable legal fees, arising from your content, your use of the Services, or your violation of these Terms or applicable law.

Termination

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, or if we discontinue the Services. Provisions that by their nature should survive termination will remain in effect, including provisions concerning ownership, disclaimers, liability, and indemnification.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Services will be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction and venue.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after updated Terms take effect means you accept the changes.
